Supreme Court threatens Trump election case with immunity ruling

The high court’s ruling threatens the federal election interference case against Trump and at least further delays a trial.

The Supreme Court on Monday finally ruled on Donald Trump’s presidential immunity claim, finding some of the former president's alleged efforts to overturn the election are immune from criminal prosecution.

In the majority opinion by Chief Justice John Roberts, the court said former presidents are entitled to "absolute immunity" from criminal prosecution for actions within their conclusive and preclusive constitutional authority. Former presidents, Roberts wrote, are entitled to at least presumptive immunity from prosecution for all their official acts. There is no immunity for unofficial acts, the court said.

The court sent the case back to the trial court to determine whether Trump’s alleged conduct is official or unofficial, which will likely add further delay to the case, making it even more unlikely to go to trial before the November election.

Liz Cheney fires back at Trump after he calls for ‘televised military tribunals’ for former congresswoman

Former Republican congresswoman Liz Cheney fired back at Donald Trump after the former president shared an image on his Truth Social page saying she was guilty of treason and should be tried during “televised military tribunals.”

“Donald – This is the type of thing that demonstrates yet again that you are not a stable adult,” she wrote on X, “and are not fit for office.”

The former Wyoming congresswoman was one of 10 House Republicans who voted to impeach the former president after the January 6 attack on the Capitol.

She also was a co-chair and one of only two Republicans on the House select committee that investigated the events surrounding and leading up to the attack, launched by a mob of Trump’s supporters to stop the certification of the 2020 presidential election.

A meme on Truth Social included a photograph of Cheney and the text “Elizabeth Lynne Cheney is guilty of treason” and “Retruth if you want televised military tribunals.”

Jack Smith Still Has Two Paths to Prosecuting Donald Trump

Special Counsel Jack Smith still has ways he could prosecute Donald Trump in the wake of the Supreme Court's immunity ruling, according to a legal expert.

Former Pentagon special counsel Ryan Goodman said there has been "a lot of misunderstanding" regarding the Supreme Court's historic ruling on Monday, and that there are still "pathways" open to federal prosecutors.

Goodman made the claim while sharing a flowchart, created by the Just Security website, explaining the possible ways that the former president could still be prosecuted in the federal 2020 election obstruction case following the decision. The nation's highest court ruled on Monday that Trump is entitled to at least presumptive immunity from prosecution for all his "official acts" carried out in office, but that he could face charges for unofficial conduct.
