What exactly about the part in bold is confusing to ya'll?

SOG: he had to get special permission becasue this is a special case and THEY ADMITTEDLY handled this case differently. Normally, the NCAA holds their own investigation but they acknowledged that with the number of witness and 3 MILLION e-mails, that this report was more thorough than any NCAA investigation.

Which again supports my argument that the rules currently place do not apply to criminal cases. This was a knee-jerk reaction by the NCAA...period.

The institution's responsibility for the conduct of its intercollegiate athletics program includes responsibility for the actions of its staff members

...as it relates to keeping the playing field leveled. Do not attempt to spin the spirit of this rule MH.

I sure as hell wasn't about to read all of that, but the very fact that Mark Emmert had to get special permission from the NCAA board to put these penalties in place is proof that they didn't have rules in place to do this.

They read right over that.:lol:
When has the NCAA ever had the authority to fine a public university?

LOL. it's so broad that it covers ALL the NCAA penalties levied. But wait til you read the last thing I just posted. :lol: The NCAA has the right to do what they want and it's in their by-laws and it's approved by the college presidents and they acted accordingly.

Then why did Emmert have to get permission if it was already on the books?

That was a horrible example to use. The NCAA aint involved in any way, shape, form, or fashion with the name of campus buildings.

Dude, I am sure you have put some by-laws together before. When you do that, you cover all bases and then lawyers look at it. It's vague for a reason. They want it that way. They wanted it that way so their azzez would be covered in a situation like this. In court, you would not be able to argue that "spirit" of a rule. You can only go by the black and white and the black and white says nothing about the the keeping a playig field level. It says if your staff does something out of line, we can get you!

Even at my job, (and I am sure at yours), when you have to make a HUGE decision, you ask the higher up to rubber stamp your decision. He just said, "this is what I wanna do, are ya'll okay with that." It is within the jurisdiction of the NCAA so they had no problem saying yes. I totally don't get the point that you and SOG are trying to make with this.

A former Committee on Infractions chairman and current Division I Appeals Committee member told ESPN.com's Katz the NCAA's penalizing of an institution and program for immoral and criminal behavior also breaks new ground.


The former chair, who has been involved with the NCAA for nearly three decades, said he couldn't use his name on the record since the case could come before him and the committee he still serves on in an appeals process.



"This is unique and this kind of power has never been tested or tried," the former chair said. "It's unprecedented to have this extensive power. This has nothing to do with the purpose of the infractions process. Nevertheless, somehow (the NCAA president and executive board) have taken it on themselves to be a commissioner and to penalize a school for improper conduct."


NCAA presidents past and present have made a point of saying they are not akin to a commissioner in professional sports and don't have the power to penalize players, coaches or schools independently.

Bro, when you write by-laws you write them to cover everything. They don't even say sport-related.. so what is your point there. How do you know they are relating it to sports? You don't according to YOUR own argument. This is a blanket statement that covers everything. When you sit in 4 hour meeting arguing about a statement that is unclear, you learn real fast how to make a blanket statement that helps your cause. Now in the case where, for instance at my job, a blanket statment may not work becasue our contracts are bargaining agreement between admins and the support staff. The support staff are not going to let us make blanket statments becasue they don't want us to have total control over them. College Presidents who want to be a part of the NCAA allow them to make blanket by-law statements.

That makes no sense. Does Sharp have to go through every SWAC President to make a decision? No. If he KNEW he had the authority already within his jurisdiction, it would make no sense for him to contact higher ups.

You got quotes from former NCAA officials who clearly say that it had no jurisdiction in this area. Were they lying.

This is similar to JSU being banned by the SWAC when there were no bylaws on the books, so Sharp had to go before Presidents and get permission because he knew he didn't have that authority.

I don't even recall all the details of the case with Joe but was it even an athletics issue? It seemed to be a university issue and it dayum sho wasn't a cover-up on this level.

Maybe ya'll need a private forum to get ya'll arguments together. Duer has to ask the Presidents about EVERY decision. :lol:

..and I contact my higher ups with every decision I make at my job. I guess it depends on your scope of the impact of your work.

Welcome to the NCAA's slippery slope. This what y'all wanted. Y'all wanted y'alls pound of flesh. However, y'all also allowed some ole Emperor Palpatine-type stuff to happen in college athletics as well. Now the NCAA has the precedent to punish programs for off-the-field incidents.

Penn State deserved to be punished, but that's what the legal system, civil courts and the US Department of Education were going to do. The NCAA basically called an audible on this and decided to unilaterally punish the school.

Now is definitely the time for athletic programs to tighten up on themselves and their student-athletes.

It will be interesting to see how the NCAA reacts next time.

And the sad thing is, these folk on here justa debating and defending Penn State and Jo Pa and all up in arms about how wrong the NCAA was to punish them for such horrible acts and the cover-up that came with them.....and all the while...the higher-ups at Penn State have accepted the punishment and are moving on....

lol... and these folk on here with no connects to the school at all on here with their panties in a bunch defending some clowns...no better word...MONSTERS! Sad...

Basically whatever decision the NCAA made,they were going to be criticized for it. If they were lenient on Penn State,there would be lot of backlash from many organizations and institutions that deal with child abuse. Now it's understandable from a sports fan point of view,some fans think that the punishment is too harsh. You know both sides make valid points, but the common denominator for the NCAA's decision was the culture of cover up at Penn State;the powers at be were covering up to protect Penn States' image. I know hind sight is 20-20. But if Joe Paterno and his superiors would have reported Sandusky to the police,Sandusky would have not been in the news as he is today. He would have been punished and dealt with. The NCAA would have seen that Penn State took matters into their own hand at FIRST notice of the report of Sandusky's actions. Shameful yes,but not as nearly as shameful of a cover up. A 14 year cover up? By Penn State administrators? To protect their image? What's that old saying a bird in hand is worth more than a thousand in a bush? Well one year of embarrasment is less painful than this long term disgrace. It's all about perspective. Again the whole point of the decision of the NCAA is that Penn State admins participated in a cover up of crimes on their campus to protect their football tradition.

Uhh no one is defending Joe Pa or Penn St. They just don't agree with the NCAA decisions. The NCAA is by far the most hypercritical organization I have ever read about or seen. On top of that, most of their rules are quite nebulous...
