So how do you call it a "just" system when they can't even punish the actual perpetrators?
Its justice because it was the Penn State head coach, the Penn State President, the Penn State AD who concealed the acts of this child molester (a Penn State coach), and gave him access to keep on molesting kids for years. Right there on the campus of Penn State

don't know why you seem to think Penn State shouldn't be punished..

So why is the NCAA involved?
IMO, they should because they showed "lack of institutional control" or moreso institutional greed when they covered up this. And by covering it up just to keep bringing in top recruits and win games, the NCAA should be involved.

Innocent people should be punished by all those people?

What people fail to realize is if you allow this nonsense to happen to one, it will eventually happen to many. An NCAA precedent has been set and now there's nothing to stop it from gaining steam and happening again.
The NCAA will now be allowed to be the judge and jury on moral and ethical issues when they farm players out to make billions of dollars off them and not pay them? Where are their ethics and morals when it comes to that?

Kill the due process argument. Penn State agreed to everything and signed a consent decree.

Like Penn State really had a choice. Can you imagine the public backlash Penn State would have gotten if the school had they not agreed to a consent decree?

The phrase "lack of institutional control" had nothing to do with moral and ethical issues in the bylaws of the NCAA. That refers to gaining an unfair advantage on the field.
They made up NEW laws to add morality and ethics, this is why they used the term "unprecedented".

Penn State, by laying down and not fighting this precedent, just allowed the NCAA in one fell swoop to gain unlimited power and authority it never had, to do whatever it wants to do when it comes to THEIR opinion on ethical and moral issues not related to on-the-field issues.

I'm not a lawyer, but I'm sure they know what I'm talking aobut.

For once, I'm agreeing with Stephen A Smith. Penn State is getting what they deserve. And Joe Pa had many chances to come out and do something about it and didn't. And Sandusky was once a 2 time Defensive Coordinator of the year, he retires? He still has access to everything on campus. And if he was so great, why didn't he accept a position at another school?

And some are forgetting the kid that reported what he saw in the shower was offered a coaching position with the team!!!!!

Smith is talking off of pure emotion as usual. He mentioned nothing related to laws and bylaws already in place.
When children are molested and abused, every state has laws and penalties already on the books to punish the actual perps.
The NCAA had no business getting it's nose involved.

Why do we fail to mention that John Gagliardi has 471 wins and is still coaching? He is the winningest football coach in college football history.

They're talking about Division I wins.

They did have a choice and chose to bend. They could easily have stated that we'll let the American judicial system decide our fate, not the NCAA, and they would've been on solid ground.

as if they are bigger than the NCAA and don't have to abide by the rules (same type thinking led to the continuation of this scandal)

ummm no school has an inherent right to be in the NCAA.

When it comes to violations, players and coaches both move on but it is the program that bears the brunt of the punishment. This is nothing new. USC probably didnt deserve to be punished for Reggie Bush's actions but that just how these things work. Current and future players have always suffered the consequences of previous violations.

That's why we have civil laws and a judicial system. When you add "civil court" to the equation, THEN you can utilize it's laws.

The NCAA didn't have the authority to do this until today because Penn State laid down and allowed it and I say shame on them.

The Penn State University lacked institutional control, hoarded and turned a blind eye to a prospective convicted felon, violated the NCAA moral clause and therefore was operating a rogue football program. The NCAA sanctions were against the institution and they were meticulous about not naming individuals. Hence, if collateral damaged transpired, the NCAA did their best to mitigate damages to the current student athletes by giving them unprecedented options. I totally endorse their decision and your perspective. :lol: :emlaugh:

(The Reggie Bush example is perfect. I was about to use another example closer to "home" that would have probably sent him on a different tangent)

So that makes it right? That same entity just got even MORE powerful today.

I'm not talking about civil or criminal laws. I understand the difference. I was asking a specific question.

Do you think the families of those abused kids should sue Penn State?

I agree to the NCAA sanctions. I hope the sanctions make all universities more aggressive in reporting pedophiles and such activities SHALL not be tolerated. There should never be another Pedophile State University (PSU).

Please cite the NCAA's moral and ethical clause specifically related to child sexual abuse.
