Wanted: Judge for Coles

The Montgomery County Circuit Court cleared its bench Monday in L.C. Cole's legal attempt to be reinstated at Alabama State University.

William Shashy became the fifth judge to remove himself from the lawsuit, which asks for Cole's return as head football coach at the school.

Charles Price -- the sixth of six circuit court judges -- has the case and is expected to recuse himself from it because his wife works at Alabama State.

"We fully expect him to. He has the closest ties of anybody," said attorney Julian McPhillips, who is representing Cole and his brother, offensive coordinator Johnnie Cole.

Price said Monday afternoon that he had not seen the case and would wait until he had to decide whether he should remove himself. He said his wife, Bernice, is a professor of English and humanities at Alabama State.

If Price recuses himself, the state judicial department would assign a judge from outside Montgomery County to hear the case.

The case started Aug. 4 when a group of Alabama State players sued for the immediate reinstatement of the Coles, who were suspended Aug. 1. The players' suit was dismissed two weeks later and the Coles filed their own suit.

Since, five Montgomery County judges have recused themselves. Judges are not required to give a reason.

Neither case has ever made it to a hearing.

Alabama State spelled out its charges against the Coles on Aug. 15, alleging the brothers made improper contact with recruits and funded strip shows for recruits.

McPhillips has asked the school to have an internal hearing on the charges, but the school has not scheduled one. ASU President Joe Lee said he would not be bullied into a hearing by McPhillips.

"Julian McPhillips does not work at Alabama State University," Lee said Monday. "We have a due process that we are going through."

Asked about the process, Lee said he would have no comment.




When are they just going to give up and let it end? I mean, the season will be over and they will still be looking for a judge.
