President Barack Obama will nominate Solicitor General Elena Kagan to the Supreme Court, a person familiar with the president's thinking said Sunday night.

The move positions the court to have three female justices for the first time in history.

The source spoke on condition of anonymity because the decision had not been made public. Obama will announce his choice at 10 a.m. Monday in the East Room of the White House.

Known as sharp and politically savvy, Kagan has led a blazing legal career: first female dean of Harvard Law School, first woman to serve as the top Supreme Court lawyer for any administration, and now first in Obama's mind to succeed legendary liberal Justice John Paul Stevens.

At 50 years old, Kagan would be the youngest justice on the court, one of many factors working in her favor. She has the chance to extend Obama's legacy for a generation.

Kagan must first win Senate confirmation.

A source close to the selection process said a central element in Obama's choice was Kagan's reputation for bringing together people of competing views and earning their respect.

Kagan came to the fore as a candidate who had worked closely with all three branches of government, a legal mind with both a sense of modesty and sense of humor. The source spoke on condition of anonymity to discuss factors that led to Kagan's impending nomination.

Kagan has clerked for Thurgood Marshall, worked for Bill Clinton and earned a stellar reputation as a student, teacher and manager of the elite academic world. Her standing has risen in Obama's eyes as his government's lawyer before the high court over the last year.

Yet Kagan would be the first justice without judicial experience in almost 40 years. All of the three other finalists she beat out for the job are federal appeals court judges, and all nine of the current justices served on the federal bench before being elevated

These women rights group must have something on Pres. Obama. He is cartering to them when it comes to these Supreme Court nominations. I guess we will never see another black get nominated.

I didn't know who but I knew it was going to be another woman.
When it come to stuff like this, Obama can be counted on to go after the PC choice.

Can we get another brotha up there..............can we?

It would be nice, but to mess around and have someone like Clarence Thomas, I'll pass.

When will yall realize that Obama is more open minded than the average black man? He's a community organizer, not a civil rights activist; that means he's interested in helping all races. IMO, he doesn't have a passion for "The Black Agenda".

Dude I'm not getting into another "ANOTHER TYPE OF black man" convo but here is a little info.

Obama is no more opened minded than the black people that voted for him.
This Supreme Court pick is str8 politics just like them REPUBS out in UTAH throwing out one of their most conservative conservative's because he was not conservative enough for the TEA PARTY..

Open mind is one thing but this woman has no experience/ZERO EXPERIENCE in writing and applying judicial law.
This was a woman's group appointment to counter the increasing anti-abortion court make-up that 99% of the people in this country could care less about in their everyday life.
What better way to do that than to appoint a "young" woman, (54), to the court that will be on the bench for the next 30 years. :lecture:

Her lack of judicial experience is an asset. One of our best ever justices (Earl Warren) was a political payback appointee with no judicial experience. Same with William Renqhuist. This trend of promoting appellate judges is a fairly recent one.

A lot of progressives (females included - they preferred Dianne Wood) aren't happy with this pick, so don't call it a women's group appoitnment. This is an attempt by Obama to add some real weight to the Court. Kagen has relationships with several of the current justices and can maybe help swing votes.

When was the first black?

I have no problem with women dominating the court. They are more humane and sympathetic..IMO.

Love a brother but why could we not get a sister. There were two great choices on the list. Let's see how Kagen holds up.

Left is mute on racial double standard in Kagan pick

"As we continue to promote the legacy of our late founding leader and Co-Convener, Dr. Dorothy I. Height, we will always seek to highlight the concerns of Black women, our families and our communities. Thus, as Dr. Height stated in our previous meeting with your Administration, we believe it is time for African American women to be represented in all sectors of government -- including the Supreme Court of the United States, which in its 221 year history has not had a Black woman nominated to serve on our highest court in the land," the letter stated.

I personally liked Deval Patrick for this seat. Looking at the current Court, barring something unforeseen I only see 1, maybe 2 more vacancies left for Obama. Thats IF he gets 2 terms. The next vacancy would probably be Ginsburg.

It would be nice, but to mess around and have someone like Clarence Thomas, I'll pass.

Thomas was nominated by a GOP president and had a pretty conservative track record. That's why it's so funny that 99.9% of blacks are now against him, but most supported him during his nomination. I guess blacks thought he was going to do a 180 once he got on the Supreme Court. Little did we know that instead of bashing Anita Hill we should have been in her corner.

Sounds like he too the safe route.

But Jeff Sessions and Mitch McConnel are gonna give her hell during the confirmation hearings.

Who gives a dam who he picks. Ain't jack gone change in the black community. Call me when it does, then I will tell you it matters.

I was... especially after he made the comment about it being a "high tech lynching" or something idiotic like that. I found it hypocritical for him to use his race while previously having a position of anti-affirmative action. Plus I really felt the mofo did what Ms. Hill stated...I couldn't see her putting herself out there like that unless it really happened.

True. But Arlan Spector and company did the necessary damage.

Very true. I believe at that time, most were happy to have a black face on the Court, and it was speculated at the time that Justice Marshall was going to resign his post. So I can see why most of us supported him at the time. As time progressed, we have become more sophisticated in who we elect or support, look closer at the issues, and would more likely support the person who is better qualified for the job. If we had heard or known Justice Marshall state that Thomas was the "wrong negro" for the job, we would be better off.

Lmao @ some of you in here....some of y'all wanna call whites racist and its a bunch of baby george jeffersons in this mofo..

I agree with CEE..why should we care what color the next appointee is...how will it benefit you?
