WASHINGTON (AP) -- U. S. Capitol Police Chief Terrance Gainer said Wednesday that Rep. Cynthia McKinney turned an officer's failure to recognize her into a criminal matter when she failed to stop at his request, and then struck him.

"He reached out and grabbed her and she turned around and hit him," Gainer said on CNN. "Even the high and the haughty should be able to stop and say, 'I'm a congressman' and then everybody moves on."

For her part, McKinney wasn't backing down from the argument. She charged anew that racism is behind what she said is a pattern of difficulty in clearing Hill security checkpoints.

"This has become much ado about hairdo," she said Wednesday on CBS's "The Early Show." McKinney, a Georgia Democrat, recently dropped her trademark cornrows in favor of a curly brown afro.

"It's much to do about nothing," Gainer told The Washington Times.

Last Wednesday's incident in a House office building has caused a commotion on Capitol Hill, where security in the era of terrorist threat is tighter than ever and where authorities had to order an evacuation just Monday because of a power outage.

McKinney has garnered little support among fellow Democrats in her feud with the Capitol police. No one in her party chose to join her at a news conference last Friday to discuss the situation, and the event was canceled.

As a federal prosecutor considers whether to press assault or other charges against her, Republicans presented a resolution commending Capitol police for professionalism toward members of Congress and visitors -- even though they "endure physical and verbal assaults in some extreme cases."

"I don't think it's fair to attack the Capitol Police and I think it's time that we show our support for them," said Rep. Patrick McHenry, R-North Carolina, a sponsor of the measure. Ignoring a police officer's order to stop, or hitting one, "is never OK," McHenry said.

Some GOP members have said the McKinney incident serves to underscore Democratic insensitivity to security concerns.

Gainer said that racism, however, was not a factor.

"I've seen our officers stop white members and black members, Latinos, male and females," he told CNN. "It's not an issue about what your race or gender is. It's an issue about making sure people who come into our building are recognized if they're not going through the magnetometer, and this officer at that moment didn't recognize her."

"It would have been real easy, as most members of Congress do, to say here's who I am or do you know who I am?" Gainer added.

Police also have said that McKinney was failing to wear a pin that lawmakers are asked to display when entering Capitol facilities.

But she said Wednesday: "Face recognition is the issue .... The pin doesn't have my name on it and it doesn't have my picture on it, and so security should not be based on a pin ... People are focused on my hairdo."

"Something that perhaps the average American just doesn't understand is that there is a heightened sense of a lack of appropriateness being there for members who are elected who happen to be of color," McKinney said, "and until this issue is addressed by the American public in a very substantive way, it won't be the last time."

I saw the interview and the Chief said she walked past the policeman and he grabbed her. Did you know that if a policeman grab you; technically there is no choice but to arrest you. Some folks claim the offficer said he asked her to stop, but the Chief said he grabbed her and she smacked him. All the Chief is saying is that you cannot hit a policeman officer. In order to correct this situation you must check everyone, because this incident has raised a major issue. Here is the legal part of this, the officer, having arrest powers should know what his responsiblities are, IMO the officer should be standing in front of the entrance like Airport security and be able to admit or turn you around if you do not have the proper identification. Now the officers on duty should be playing hard ball everyday without exception to ensure they are policing within the guidelines. Looks like he grabbed the wrong one. If the citizens from Georgia were mistreated as stated by McKinney, you know they had it in for her, because I am sure she mentioned the Georgia situation to the Chief.

250 Black Officers filed a compliant on the Capitol Police. There must be something going on in the ranks.

You are right. It questions the whole security apparatus in the Capitol. Why was'nt there film footage of the incident?

This is a distraction. It should have never reached this level. This incident has moved DeLay's resignation and McCain pandering to the "Religous Right" off the front page. There are far more critical issues to be discuss. Both sides need to lower the rhetoric.

I can add some personal perspective to this discussion. I have been in this Building. I served as a 'Junior Clerk' for part of a summer back in High School. The security checkpoints were there then. The House has a 'standing protocol' that allows members of the House to bypass the security checkpoints. Each House member is given a lapell pin (round brass pin) that they wear. Capitol police are to acknowledge that pin and allow them to enter the building without being subjected to the metal detectors and x-ray equipment (like everybody else).

And being that this was her Office building, she comes and goes dozens of times in a given day, so all of the Capitol police should know who she is...

I think what happened was this: I think she walked in (how she usually does) and approaches the checkpoint. She proceeds to walk around it, how she normally does. I think the Capitol police officer doesn't see the lapell pin and doesn't recognize her (initially) because SHE HAS CHANGED HER HAIR STYLE... And because of this he says something to her. I don't think she hears him (or really pays him any attention) and keeps walking. The police officer then grabs her to prevent her from continuing (as he should, when doing his job). And in this instant moment, she simply reacts and hits him in the chest with her cellphone (she may even have been talking on it when he grabbed her).

I don't think this was racially motivated or any of the other claims she's making (although those claims may be true, but not in THIS instance). I simply think the police officer didn't see the pin and didn't recognize her face because of the new hairdo (which looks a hot mess by the way).......

This was a simple misunderstanding... When the Officer does recognize who she is, he should've apologized. I'm sure she would've too, after he explains that he didn't see the pin and didn't recognize her with her new hairdo.

But it's been blown WAY outta proportion.

Now a Grand Jury's been conviened........

Very logical...I agree. Yet she should have never hit him....no it's crazy and as someone stated earlier blocked some things that have been happening.

Now this I can agree to. Espcially if she recently changed her hairdo, however with that your reaction was not acceptable. She is the Congresswoman, and she should have taken the higher road by bringing to his attention of who she was.

I do not agree with summoning a Grand Jury on this. This is as bad as proceeding with impeachment for a blow job. this is truly the end of the world.

She was dead wrong!!!

I can't understand why she keep saying this incident was racially motivated. The only reason the capital police is sending this to the grand jury is because she is using the race card and they wanna prove she was wrong. I'm sure they would have let it go if she would have said, "I apologize for hitting the officer who is in charge of protecting the capital and keeping me safe. I was simply wrong."

I HAVEN'T SEEN ONE PERSON IN CONGRESS, BLACK OR WHITE, REPUBLICAN OR DEMOCRAT, SUPPORT HER ON THIS INCIDENT...YET SHE FEELS SHE DID NOTHING WRONG.:shame:

Most Policemen use TV tactics to police. I based my opinion on what I heard the Chief stated on National TV. Most citizens don't know the rule of law, therefore, they end up in the slammer. Now that you have an incident with a congresswomen, the stakes are higher. What will this do to the immunity law? Will all the special consideration given to congress be stopped? If the pin is the issue, then they must change the process. I would like to know if this was the first day this officer was on the job. I don't think a rookie would be on the door at this level. I believe only the most Senior Policemen would be working the position he was in. Maybe the black officers are complaining because they are assigned to street duties, rather than in the most attractive positions.

the one thing that I noticed the chief said during the interview about the pin was its intended use. He said the pin is used to identify the congressperson, but what the officer does is notice the pin and puts the face with the pin. he says that it doesn't automatically grant you access.

I do not think that this was a racial incident at all. I think its basically an officer not initially recognizing someone and trying to slow her down to make sure that she was legit.

I do have to tip my hat to Soledad, she was taking her shots at McKinney. I especially like how she told her that "this is my show" and then at the end when she says that if these question had been answered earlier then maybe we could have discussed some of the other issues.

By allowing the Congressmen to bypass the security, the police played a role in this. Had the rule simply be that Congressmen MUST have the i.d. and/or the pen, then there would be no questions.

Heck, when McKinney initially had the problem of not being recognized, the solution at that time should have been that i.d./pen is required for everybody. Apparently, that wasn't their solution. Their solution was to post McKinney's picture and still allow the members to skirt security.

McKinney apologizes for scuffle with officer
Grand jury to hear testimony on incident, sources say

WASHINGTON (CNN) -- Rep. Cynthia McKinney apologized on the House floor Thursday for a confrontation with a Capitol Police officer last week.

"There should not have been any physical contact in this incident," McKinney said.

"I am sorry that this misunderstanding happened at all, and I regret its escalation and I apologize," she said surrounded by colleagues on the House floor.

She said she would vote for a resolution expressing support for the efforts of Capitol Police.

McKinney's apology came as a District of Columbia grand jury was to begin hearing testimony Thursday related to the confrontation, sources said Wednesday.

A decision on whether the Georgia congresswoman will be charged could come as early as next week, federal law enforcement sources said.

Senior congressional sources said that two House staff members -- Troy Phillips, an aide to Rep. Sam Farr, D-California, and Lisa Subrize, executive assistant to Rep. Thaddeus McCotter, R-Michigan -- have been subpoenaed to testify.

Police say McKinney struck a Capitol Police officer last week when the officer did not recognize her as a member of Congress and tried to stop her from entering a House office building when she did not present identification.

McKinney accuses the officer of "inappropriate touching" and racial profiling in the incident.

The Justice Department and the U.S. attorney for the District of Columbia, which is handling the case, refused to comment.

James Myart, an attorney representing McKinney, said he wouldn't be surprised if his client were indicted.

"Grand juries do what grand juries do," Myart said. "However, I would think that they would recognize that there simply is not enough evidence here to even bring an indictment."

Members of the Congressional Black Caucus, which has declined to comment because the facts of the case are in dispute, met Wednesday evening to discuss the incident. McKinney was in attendance.

Also Wednesday, McKinney deflected questions about the confrontation, while the Capitol Police chief said the lawmaker should have known better. (Watch McKinney deflect questions -- 10:46)

Capitol Police Chief Terrance Gainer said McKinney didn't stop at an officer's request, then turned around and hit him after he grabbed her when she passed a security checkpoint.

"Any time an officer does not know who the person is coming in the building, I direct them to stop that person. And even if you're stopped, you're not supposed to hit a police officer. It's very simple," he said. "Even the high and the haughty should be able to stop and say, 'I'm a congressman,' and then everybody moves on."

But Myart said that Gainer and other officers went to McKinney's office after the dispute and apologized for the officer's conduct. Myart also questioned why McKinney wasn't arrested on the spot for assaulting an officer, if that is in fact what happened.

Citing potential criminal charges against McKinney, another of her attorneys, Mike Raffauf, said Wednesday his client would not discuss specifics of the case.

McKinney has acknowledged that when she was stopped she was not wearing the lapel pin given to lawmakers. The lawmaker said the identification pin is irrelevant.

"It doesn't have a face or a photo ID on it, and quite frankly it can be duplicated," she said.

McKinney and her attorneys insist that Capitol Police officers should be trained to recognize all 535 members of Congress on sight.

But while Myart has said McKinney was "assaulted" and that her reaction to the officer was appropriate, Gainer argued that McKinney has turned an officer's failure to recognize her into a criminal matter.

Gainer said race was not an issue and that he has seen officers stop and question white, black and Latino members of Congress. He added that officers are given photos of new members of Congress, but with 30,000 employees in the Capitol complex and more than 9 million visitors a year, officers have "to make sure we know who is coming in the building."

Republicans have seized the opportunity to take shots at the legislator. Rep. Tom DeLay, R-Texas, called McKinney a "racist" on Fox News Channel and House Speaker Dennis Hastert, R-Illinois, downplayed the Georgia lawmaker's allegation of racial profiling.

"This is not about personalities. It's not about somebody's ego. It's not about racial profiling," Hastert said. "It's trying to make this place safer and working with the people that try to make it safer."

Also, two Republican members introduced a resolution Tuesday commending the Capitol Police for their "continued courage and professionalism." (Full story)

McKinney, 51, represents Georgia's 4th Congressional District, a majority-black, Democratic district on the east side of metro Atlanta.

First elected in 1992, she was defeated in a 2002 Democratic primary but made a comeback in 2004, winning her old seat after the candidate who had defeated her two years earlier decided to run for the U.S. Senate.
