Affidavit: Sex with Cole occurred before alleged rape

ATHENS, Ga. -- An affidavit says one of the University of Georgia athletes suspended in a rape investigation had consensual sex with the alleged victim earlier that night.

The Athens Banner-Herald reported Wednesday that the information was from a Jan. 15 search warrant affidavit.

University police Detective Eric Dellinger wrote that the woman reported she had consensual sex with junior basketball guard Tony Cole before two other men accosted her in Cole's dorm room.

Cole has been dismissed from the team, Georgia athletics department officials told the Atlanta Journal-Constitution on Saturday.

The affidavit says the woman told police that after she and Cole had sex, Cole went to a bathroom and a man she didn't know emerged from a closet and sexually molested her. The woman told the man to stop, and he left after several unsuccessful attempts to rape her.

The woman told police she went to the bathroom and when she returned, sophomore basketball player Steven Thomas got on top of her and the two had sex. The affidavit does not indicate whether the sex was consensual. The woman initially reported to police that she was raped by someone she knew.

Last week, Cole, Thomas and junior football cornerback Brandon Williams were suspended by athletic officials. University police said a basketball player was accused of rape and a football player of attempted rape. Another basketball player, was identified as being an accessory.

No charges have been filed.
