Supreme Court upholds Obama health care law

The Supreme Court upheld the health care law today in a splintered, complex opinion that appears to give President Obama a major victory.

Basically. the justices said that the individual mandate -- the requirement that most Americans buy health insurance or pay a fine -- is constitutional as a tax.

Chief Justice John Roberts -- a conservative appointed by President George W. Bush -- provided the key vote to preserve the landmark health care law, which figures to be a major issue in Obama's re-election bid against Republican opponent Mitt Romney.

In their dissent, Justices Scalia, Kennedy, Thomas and Alito describe the Affordable Care Act as a "massive state-administered federal welfare program," and argue that the decision should have been a no-brainer:


What is absolutely clear, affirmed by the text of the 1789 Constitution, by the Tenth Amendment ratified in 1791, and by innumerable cases of ours in the 220 years since, is that there are structural limits upon federal power—upon what it can prescribe with respect to private conduct, and upon what it can impose upon the sovereign States. Whatever may be the conceptual limits upon the Commerce Clause and upon the power to tax and spend, they cannot be such as will enable the Federal Government to regulate all private conduct and to compel the States to function as administrators of federal programs.
And they wanted the whole law invalidated -- every bit of it.


The Act before us here exceeds federal power both in mandating the purchase of health insurance and in denying nonconsenting States all Medicaid funding. These parts of the Act are central to its design and operation, and all the Act’s other provisions would not have been enacted without them. In our view it must follow that the entire statute is inoperative.
 
I think it was good that this ruling occurred because of the fact that some the provisions which allow for the poor to get affordable insurance and from that you have medicaid that expanded in which it will be offered to a broader range of civilians just to name a few!
 
The true winner in the decision, the Insurance Industry. Remember the laws says you have to have health insurance. Where is the money going to come from.
 
I am shocked. This court is so political and so corporate - for John to take this stance and rule on the law and not politics is truly shocking.

I did hear Chief Justice John Roberts college law professor on BBC radio this morning predict that he would uphold the law. The reason is that the law does not force you to buy health insurance, but you will pay a higher taxes if you dont. Congress has the power to tax which makes the "mandate" constitutional.
